Terms of Service

MailTriggeris a “bring your own key” (BYOK) email automation platform. You connect your own email service provider, upload your own contacts, build sequences, and the Service sends and follows up on your behalf using your provider and sender identity.

You must be at least 16 and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.

You are solely responsible for the recipients you email and the content you send. By using the Service you represent and warrant that, for every recipient you contact:

• You have a lawful basis and any required consent to email them, and a genuine relationship or legitimate interest where the law requires one.
• Your sending complies with all applicable laws, including CAN-SPAM, GDPR, CASL, and other anti-spam and data-protection laws in the recipient’s jurisdiction.
• You include accurate sender information and a functioning unsubscribe mechanism, and you promptly honor opt-out requests.

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or message purchased, scraped, or rented lists without a lawful basis.
• Send deceptive, fraudulent, harassing, or unlawful content, or malware or phishing.
• Impersonate any person or entity, or falsify headers or sender identity.
• Violate the terms or acceptable-use policies of your connected email provider.

The contacts you upload remain yours and are processed on your behalf. We do not use your uploaded contacts for our own marketing, and we will not email them except as you direct through the Service. We may suspend or terminate accounts that violate this section.

You are responsible for connecting and maintaining your own email provider, complying with that provider’s terms, and for your own sender reputation and deliverability. MailTrigger does not guarantee inbox placement, delivery rates, or that any provider will accept your traffic.

The Service offers a free plan and paid plans with higher usage limits. Paid plans are billed in advance through our third-party payment processor and renew automatically until cancelled. Plan limits (such as contact and sending limits) are enforced by the Service. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.

We retain all rights in the Service. You retain all rights in your contacts, content, and campaigns. You grant us a limited license to host and process your content solely to operate the Service for you.

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that emails will be delivered.

To the maximum extent permitted by law, MailTrigger will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless MailTriggerfrom any claims, damages, and expenses arising from your use of the Service, your content, your contacts, or your violation of these Terms or applicable law — including any claim brought by a recipient you emailed.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms or for abuse. Upon termination, your right to use the Service ends and we may delete your data as described in our Privacy Policy.

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. The courts located in India will have exclusive jurisdiction over any dispute.

We may update these Terms from time to time. Material changes will be reflected by an updated effective date and, where appropriate, notice to you. Continued use after changes take effect constitutes acceptance.
